This Doctor Agreement (“Agreement”) governs the use of Homeobay (“Platform”, “Website”, “we”, “our”, or “us”) by healthcare professionals (“Doctor”, “Healthcare Professional”, “Practitioner”, or “you”).

By registering, creating a profile, listing services, or using Homeobay, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

1. PURPOSE OF THE PLATFORM

Homeobay is an online healthcare marketplace that facilitates connections between patients and independent healthcare professionals.

Homeobay acts solely as a technology intermediary and does not provide medical services, diagnosis, treatment, or healthcare advice.

2. ELIGIBILITY

To register as a Doctor on Homeobay, you must:

  • Possess valid professional qualifications recognized by applicable authorities;

  • Hold all required registrations, licenses, certifications, and permissions necessary to practice legally;

  • Be authorized to provide healthcare consultations under applicable laws;

  • Provide accurate and truthful information at all times.

Homeobay reserves the right to verify qualifications and professional credentials.

3. INDEPENDENT PROFESSIONAL STATUS

Doctors using Homeobay are independent professionals.

Nothing in this Agreement shall be construed as creating:

  • Employment;

  • Partnership;

  • Joint venture;

  • Agency relationship;

between Homeobay and any Doctor.

Doctors are solely responsible for their professional services.

4. PROFILE INFORMATION

Doctors agree that all information provided on their profile shall be:

  • Accurate;

  • Complete;

  • Current;

  • Not misleading.

This includes:

  • Name;

  • Qualifications;

  • Registration numbers;

  • Experience;

  • Clinic information;

  • Consultation fees;

  • Specializations;

  • Availability schedules.

Doctors must promptly update any changes.

5. PROFESSIONAL RESPONSIBILITIES

Doctors are solely responsible for:

  • Medical advice;

  • Diagnosis;

  • Prescriptions;

  • Treatment recommendations;

  • Follow-up care;

  • Clinical decisions;

  • Record keeping where required by law.

Homeobay does not supervise or control medical practice.

6. COMPLIANCE WITH LAWS

Doctors agree to comply with:

  • All applicable healthcare laws and regulations;

  • Professional ethics and codes of conduct;

  • Telemedicine regulations, where applicable;

  • Consumer protection laws;

  • Data privacy and confidentiality obligations.

Doctors shall be solely responsible for obtaining any licenses, permissions, or approvals required to provide healthcare services.

7. CONSULTATION FEES

Doctors may set their own consultation fees through the Platform.

Homeobay reserves the right to:

  • Charge platform fees;

  • Charge subscription fees;

  • Charge listing fees;

  • Deduct commissions where applicable.

Details of such fees shall be communicated separately.

8. APPOINTMENTS AND AVAILABILITY

Doctors are responsible for:

  • Maintaining accurate availability schedules;

  • Honoring confirmed appointments;

  • Promptly informing patients regarding cancellations or rescheduling.

Repeated cancellations may result in suspension or removal from the Platform.

9. PATIENT COMMUNICATION

Doctors shall communicate professionally and respectfully with patients.

Doctors shall not:

  • Harass users;

  • Misrepresent qualifications;

  • Make misleading claims;

  • Engage in fraudulent practices;

  • Provide unlawful treatments or services.

10. PATIENT DATA AND CONFIDENTIALITY

Doctors acknowledge that patient information is confidential.

Doctors agree to:

  • Protect patient privacy;

  • Use patient information solely for healthcare purposes;

  • Maintain confidentiality in accordance with applicable laws;

  • Not disclose patient information without lawful authorization.

11. REVIEWS AND RATINGS

Patients may submit reviews and ratings regarding their consultation experience.

Doctors shall not:

  • Manipulate reviews;

  • Offer incentives for positive reviews;

  • Submit false reviews;

  • Harass patients regarding reviews.

Homeobay reserves the right to remove reviews that violate Platform policies.

12. PROHIBITED ACTIVITIES

Doctors shall not:

  • Submit false credentials;

  • Misrepresent qualifications;

  • Provide unlawful medical advice;

  • Violate applicable laws;

  • Upload harmful content;

  • Interfere with Platform operations;

  • Circumvent payment systems where platform fees apply.

13. PLATFORM VERIFICATION

Homeobay may request verification documents including:

  • Registration certificates;

  • Degree certificates;

  • Government-issued identification;

  • Professional licenses.

Homeobay reserves the right to suspend or remove accounts that fail verification requirements.

14. INTELLECTUAL PROPERTY

Doctors grant Homeobay a non-exclusive license to display:

  • Profile information;

  • Professional photographs;

  • Clinic details;

  • Professional credentials;

for purposes of operating and promoting the Platform.

Ownership of professional content remains with the Doctor.

15. LIMITATION OF LIABILITY

Homeobay shall not be liable for:

  • Medical outcomes;

  • Patient disputes;

  • Professional negligence claims;

  • Loss of income;

  • Reputational harm;

  • Regulatory actions against Doctors.

Doctors remain solely responsible for the services they provide.

16. INDEMNIFICATION

Doctors agree to indemnify and hold harmless Homeobay, its owners, employees, affiliates, and representatives from any claims, liabilities, damages, costs, or legal expenses arising from:

  • Professional services provided by the Doctor;

  • Breach of this Agreement;

  • Violation of applicable laws;

  • Patient complaints or claims.

17. SUSPENSION AND TERMINATION

Homeobay reserves the right to suspend, restrict, or terminate any Doctor account for:

  • False information;

  • Credential issues;

  • Professional misconduct;

  • Violation of Platform policies;

  • Legal or regulatory concerns.

Termination may occur without prior notice where necessary to protect users or comply with legal obligations.

18. PLATFORM MODIFICATIONS

Homeobay may modify:

  • Features;

  • Policies;

  • Fee structures;

  • Technical requirements;

at any time.

Continued use of the Platform constitutes acceptance of such modifications.

19. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of India.

Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the competent courts located in Odisha, India.

  • You have read this Agreement;

  • You understand your professional responsibilities;

  • You agree to comply with all applicable laws and regulations;

  • You accept the terms and conditions contained herein.
